TERMS AND CONDITIONS OF PURCHASE
1, General
1.1 These general terms and conditions (the "Terms") apply when you as a consumer ("You") place an order via www.butikkom.com ("the Site"). An agreement is entered into between you and Butikkom (Karzoun Grossist AB), organization number 5594115908. Detailed contact information and other information about Butikkom are available on the Site. The Terms are only applicable to you as a consumer who places orders via the Site.
1.2 To order on the Site, you must be 18 years old. Butikkom does not accept credit purchases for individuals under 18 years of age, according to Swedish law. Butikkom reserves the right to refuse or change your order in individual cases (e.g., if you have provided incorrect personal data and/or have a high risk of fraud).
1.3 Butikkom reserves the right for out-of-stock situations and any image and typographical errors on the Site, such as errors in product descriptions or technical specifications, incorrect prices, and price adjustments (such as changed prices from suppliers or currency changes) or incorrect information regarding whether an item is in stock. Butikkom has the right to correct any such errors and to change or update the information at any time. If an incorrect price has been stated for an item you have ordered, Butikkom will naturally inform you of this and await your approval of the corrected price before Butikkom proceeds with the order. All image information on the Site should be seen exclusively as illustrations. Such illustrations cannot guarantee the exact appearance of the item.
1.4 The Site, and all content on it, is owned by Butikkom or its licensors. The information is protected by intellectual property and marketing laws, among others. This means that trademarks, company names, product names, images and graphics, design, layout, and information about goods, services, and other content may not be copied or used without written approval from Butikkom.
2, Agreement and Order
2.1 To make a purchase via the Site, you must accept the Terms. By accepting the Terms, you agree to comply with the Terms in their entirety, and approve that you have read the information about personal data and consented to the use of personal data and cookies in accordance with Butikkom's Privacy Policy.
2.2 A purchase agreement is only concluded when Butikkom has confirmed your order and you have received an order confirmation from Butikkom by e-mail. Butikkom encourages you to save this order confirmation for any contact with Butikkom's customer service. You can revoke your order until it has been confirmed by Butikkom. If the order is revoked, Butikkom will refund any payments you or your payment or credit card companies have made regarding the order.
3, Customer information etc.
3.1 When you register your user account and/or are to place an order, you will be asked to provide certain personal data. You confirm that the information you fill in is correct and complete and are responsible for incorrectly filled-in data. Information about Butikkom's processing of personal data can be found in Butikkom's Privacy Policy.
3.2 You undertake to ensure that no one else can use your login details. You must not disclose your username and password to any unauthorized person and must ensure that documents containing your username and password are stored in such a way that unauthorized persons cannot access the information. You must immediately notify Butikkom if it is suspected that an unauthorized person has gained access to your password. You are responsible for all purchases made with your login details if such notification has not been made.
3.3 If Butikkom suspects that you are misusing your user account or your login details or otherwise violating the Terms, Butikkom has the right to suspend you. Butikkom also has the right to assign you new login details.
4, Prices, fees and payment
4.1 When ordering via the Site, the prices stated on the Site apply. Prices are stated in Swedish Kronor and include VAT. Prices do not include payment and shipping fees, which are stated separately.
4.2 You can pay by the methods specified on the Site. Butikkom has the right to charge for the order already at the time of placing it, unless invoice payment or another similar payment method has been chosen by you and approved by Butikkom. For invoice payment or partial payment, Butikkom or its partners may conduct a credit check. You will be informed if this occurs. Butikkom reserves the right not to always offer all payment methods, or to change payment methods if the one you have chosen does not work for any reason at the time of purchase. Please note that any limitations on payment options are stated on the Site.
5, Campaigns and offers
Butikkom may from time to time offer campaigns on the Site that may have more favorable terms than those stated in these Terms, e.g., regarding payment or extended right of withdrawal. These more favorable terms apply as long as the campaign is active and for the specific goods specified by Butikkom in connection with the campaign. Butikkom reserves the right to withdraw such campaigns at any time. Upon termination or withdrawal of a campaign, these Terms apply without changes. Offers on specific goods on the Site are valid for a limited time and while stocks last.
6, Gift Cards
Gift cards sold at Butikkom are valid for two (2) years from the date of issue and can be used on Butikkom's webshop. After the validity period expires, the card cannot be used as a means of payment, cannot be reactivated, and the remaining value cannot be refunded. Your gift card is a document of value that should be stored securely and cannot be exchanged for cash. Lost or stolen cards will not be replaced.
7, Delivery and transport
7.1 Items in stock are normally delivered within the number of working days specified on the Site. Unless otherwise specifically agreed (e.g., in connection with booking items not in stock), delivery will take place no later than 30 working days from the date Butikkom confirmed the order in writing via the order confirmation. The delivery time is 2-5 working days in Sweden. We always send 1st class shipments. During major campaigns or bad weather conditions, it may take slightly longer.
7.2 The expected delivery time of the item is stated in the order confirmation, at the checkout and/or on the relevant item page on the Site. Unless otherwise specifically agreed and a delivery takes more than 30 business days and this is not due to you as a customer, you have the right to cancel the purchase.
7.3 If packages are to be collected, you must do so within the time specified in the notification. Packages should normally be collected in person with valid identification and order number. You will always receive a notification stating where and when the package should be collected. Notification can be sent via email, regular mail and, if you have provided a mobile number, also via phone call or SMS. If you do not collect the package, Butikkom has the right to charge you a fee of 299 SEK for work performed and shipping costs. For orders with an order value exceeding 1500 SEK, 25% of the order's value will be charged for uncollected packages. Please note that uncollected packages do not fall within the scope of the right of withdrawal or free returns.
8, Right of withdrawal
8.1 When purchasing goods on the Site, a 14-day right of withdrawal always applies. This means that you have the right to cancel your purchase by notifying Butikkom within 14 days from the date you or your agent received the ordered item (the withdrawal period). Please note that if the product's quality has been affected as a result of you as a customer handling the item more than is necessary to examine its properties or functions, a deduction from the refund corresponding to the item's depreciation in value will be made, e.g., defective packaging.
8.2 In connection with an order for an item for which the right of withdrawal does not apply, you will receive clear information about this. If an item has been sealed, you may not break the seal if you wish to exercise your right of withdrawal. The right to withdraw therefore ceases when you break the seal.
8.3 Right of withdrawal for food, when ordering food, there is no right of withdrawal.
8.4 If you wish to cancel the purchase, you must send a clear and unequivocal message to Butikkom before the withdrawal period expires. You must provide your name, address, and other relevant information, such as order number, invoice number, and the name of the item in the message.
8.5 When exercising the right of withdrawal, you pay the return shipping and are responsible for the condition of the item after you have received it and during return shipping. The item must be returned within 14 days from the date the notice of exercising the right of withdrawal was given to Butikkom. The item must be sent back well packaged, in good condition and in its original box. Returns must be made to Butikkom according to the methods and instructions specified on the Site.
8.6 When you cancel your purchase, Butikkom will refund the amount you paid for the item, excluding 69 SEK delivery costs. From the amount to be refunded, Butikkom has the right to deduct a sum corresponding to the item's depreciation in value compared to its original value, if and to the extent that such depreciation is due to you having handled the item more than is necessary to ascertain its properties or function.
8.7 Butikkom will refund the amount as soon as possible, but no later than 14 days from the date Butikkom received your notice of exercising the right of withdrawal. However, Butikkom may withhold the refund until Butikkom has received the item or you have demonstrated that the item has been returned, e.g., by means of a delivery receipt. The refund will be made to you via the payment option you chose, unless otherwise agreed or there are obstacles to such a refund. Butikkom takes no responsibility for Klarna's refund and case management time.
9, Warranty and Complaints
9.1 Some of Butikkom's goods may be covered by a warranty. Information about any warranty period and specific warranty conditions for each item can be found on the Site or in these Terms. The warranty for goods only covers original manufacturing defects, and therefore not defects that arise during or after a self-modification of the item's function and appearance, such as rebuilding, upgrading, or other configuration of the item; this does not apply to food. Your order confirmation serves as proof of warranty.
9.2 The right to complain covers goods that are faulty according to applicable consumer protection legislation. Customers who wish to assert a defect in an ordered item must contact Butikkom as soon as possible after discovering the defect via the contact details provided on the Site. Complaints made within three weeks of you discovering the defect are always considered to have been submitted in good time. When purchasing food and you discover that the goods are damaged during transport, you must send pictures of the box and all damaged products, then contact Butikkom no later than 48 hours after you have picked up the package from the Servicepoint.
9.3 Cans for Collectors: Unfortunately, we cannot guarantee that cans containing beverages will arrive in perfect condition without cosmetic defects. Butikkom does its utmost to pack the goods as well as possible to prevent this, however, we receive cans from our suppliers that already have some blemishes before they are sent out to the Customer.
9.4 Butikkom is responsible for return shipping for approved complaints.
9.5 When a complained item has been returned and the complaint approved, Butikkom will compensate you in accordance with applicable consumer protection legislation. Butikkom strives for this to occur within 14 days from the date Butikkom received the complaint, but it may take longer depending on the nature of the item. Butikkom reserves the right to deny a complaint if it turns out that the item is not faulty according to applicable consumer protection legislation. 10, Force Majeure
Butikkom is not responsible for delays caused by circumstances beyond Butikkom's control, such as general labor disputes, extreme weather conditions, war, fire, lightning, terrorist attack, changed government regulations, technical problems, faults in electricity/telephone/data connections or other communications, as well as faults or delays in services from subcontractors due to circumstances as stated herein. These circumstances shall constitute grounds for exemption, leading to exemption from damages and other penalties. If such a situation arises, Butikkom will inform you both at the beginning and at the end of the period of the relevant situation. If the circumstance has lasted longer than two months, both you and Butikkom have the right to cancel the purchase with immediate effect.
11, Changes to the Terms
Butikkom reserves the right to make changes to these Terms at any time. All changes to these Terms will be published on the Site. Changes apply from when you have accepted the Terms (in connection with a new purchase or when visiting the Site), or 30 days after Butikkom has informed you of the changes. Butikkom recommends that you keep yourself updated on the Site regularly to be aware of any changes to the Terms.
12, Applicable law and dispute
12.1 Disputes should primarily be resolved amicably after discussion with Butikkom's customer service.
12.2 If a dispute cannot be resolved amicably with Butikkom's customer service, you as a customer can turn to ARN (the National Board for Consumer Disputes), where you can find more information at www.arn.se. You can also submit a complaint directly online via the EU Commission's dispute resolution platform, which you can find via the following link: http://ec.europa.eu/consumers/odr. If you submit a complaint via this platform, your case will automatically be forwarded to the correct national dispute resolution body. This dispute resolution body will then contact us and try to resolve the dispute without involving a court. In the event of a dispute, Butikkom will follow decisions from ARN or an equivalent dispute resolution body.
12.3 Disputes concerning the interpretation or application of these Terms shall be interpreted in accordance with Swedish law and decided according to section 12.2 above or, ultimately, by a public court.
