TERMS OF PURCHASE

1. General

1.1 These general terms and conditions ("Terms") apply when you as a consumer ("You") place an order via www.butikkom.com (“Site”). Agreement is concluded between you and Butikkom, organization number 860125-8513. Detailed contact details and other information about Butikkom can be found on the Site. The terms and conditions are only applicable to you who are consumers and who place orders via the Site.

1.2 In order to order on the Site, you must be 18 years of age. According to Swedish law, Butikkom does not accept credit purchases for people under the age of 18. Butikkom reserves the right in individual cases to refuse or change your order (for example, if you have provided incorrect personal data and/or there is a high risk of fraud).

1.3 Butikkom reserves itself for final sales and any image and writing errors on the Site, for example errors in product description or technical specification, incorrect prices and price adjustments (such as changed prices from suppliers or currency changes) or incorrect information regarding whether an item is in stock. Butikkom has the right to correct any such errors and to change or update the information at any time. If an incorrect price has been entered for an item you have ordered, Butikkom will of course notify you of this and wait for your approval of the corrected price before Butikkom continues with the order. All image information on the Site must be viewed exclusively as illustrations. Such illustrations cannot guarantee the exact appearance of the item.

1.4 The site, as well as all content on it, is owned by Butikkom or its licensors. The information is protected by, among other things, intellectual property and market laws. This means that trademarks, company names, product names, images and graphics, design, layout and information about goods, services and other content may not be copied or used without written approval from Butikkom.

2, Agreement and Order

2.1 In order to make a purchase via the Site, you must accept the Terms. By accepting the Terms and Conditions, you undertake to follow the Terms and Conditions in their entirety, as well as agree that you have read the information about personal data and consented to the use of personal data and cookies in accordance with Butikkom's Privacy Policy.

2.2 A purchase agreement is only entered into when Butikkom has confirmed your order and you have received an order confirmation from Butikkom by e-mail. Butikkom invites you to save this order confirmation for any contacts with Butikkom's customer service. You can cancel your order until it has been confirmed by Butikkom. If the order is cancelled, Butikkom will refund all possible payments that you or your payment or credit card companies have made regarding the order.

3, Customer information etc.

3.1 When you register your user account and/or place an order, you will be asked to provide certain personal data. You confirm that the information you fill in is correct and complete, and you are responsible for incorrectly filled information. Information about Butikkom's processing of personal data can be found in Butikkom's Privacy Policy.

3.2 You undertake to ensure that no one else can use your login details. You may not disclose username and password to any unauthorized person and must ensure that documents containing information about username and password are stored in such a way that unauthorized persons cannot gain access to the information. You must immediately notify Butikkom if it is suspected that an unauthorized person has gained access to your password. You are responsible for all purchases made with your login details if such notification has not been made.

3.3 If Butikkom suspects that you are abusing your user account or your login details or otherwise violate the Terms, Butikkom has the right to suspend you. Butikkom also has the right to assign you new login details.

4, Prices, Fees and Payment

4.1 When ordering via the Site, the prices stated on the Site apply. Prices are stated in Swedish kronor and include VAT. Prices do not include payment and shipping fees, which are listed separately.

4.2 You can pay in the ways specified on the Site. Butikkom has the right to charge already in connection with the order, unless invoice payment or another similar payment method has been chosen by you and approved by Butikkom. In case of invoice payment or partial payment, Butikkom or its partners may make a credit report. In such case, you will be informed about this. Butikkom reserves the right not to always offer all payment methods, or to change the payment method if the one you have chosen for some reason does not work at the time of purchase. Please note that any restrictions on payment options are stated on the Site.

5, Promotions and Offers

Butikkom may from time to time offer promotions on the Site that may have more favorable terms than what appears in these Terms, e.g. regarding payment or extended right of withdrawal. These more favorable conditions apply as long as the campaign is active and for the specific goods specified by Butikkom in connection with the campaign. Butikkom reserves the right to withdraw such promotions at any time. In the event of termination or cancellation of a campaign, these Terms and Conditions apply without modification. Offers on specific goods on the Site are valid for a limited time and while stocks last.

6, Gift cards

Gift cards sold at Butikkom are valid for two (2) years from the date of issue and can be used at Butikkom's webshop. Once the validity period has expired, the card cannot be used as a means of payment, cannot be reactivated and the remaining value cannot be refunded. Your gift card is a document of value that must be kept securely and cannot be exchanged for money. Lost or stolen cards are not replaced.

7, Delivery and Transport

7.1 Goods that are in stock are normally delivered within the number of working days specified on the Site. Unless otherwise specifically agreed (e.g. in connection with the booking of goods that are not in stock), delivery takes place no later than 30 working days from when Butikkom has confirmed the order in writing through the order confirmation. The delivery time is 2-5 working days in Sweden. We always send 1st class items. In case of larger campaigns or bad weather conditions, it may take slightly longer.

7.2 The expected delivery time of the product is shown in the order confirmation, in the checkout and/or on the relevant product page on the Site. Unless otherwise specifically agreed and a delivery takes more than 30 working days and this is not due to you as a customer, you have the right to cancel the purchase.

7.3 If packages are to be redeemed, you must do this within the time specified in the notification. Packages must normally be picked up in person with valid identification and order number. You always receive a notification that shows where and when packages are to be picked up. Notification can take place via e-mail, regular mail and, if you have provided a mobile number, also via phone calls or SMS. If you do not pick up the package, Butikkom has the right to charge you a fee of SEK 250 for work done and shipping fees. For orders whose order value exceeds SEK 1,500, 25% of the order value is charged for unclaimed packages. Please note that unredeemed packages do not fall within the scope of the right of cancellation or free returns.

8, Right of withdrawal

8.1 When purchasing goods on the Site, a 14-day right of withdrawal always applies. This means that you have the right to cancel your purchase by notifying Butikkom within 14 days of you or your representative receiving the ordered item (the cancellation period). Note that if the quality of the product has been affected as a result of you as the customer having handled the product more than is necessary to examine its properties or functions, a deduction will be made from the refund corresponding to the decrease in value of the product, e.g. defective packaging.

8.2 In connection with an order for goods for which the right of withdrawal does not apply, you will receive clear information about this. If an item has been sealed, you must not break the seal if you want to be able to exercise your right of withdrawal. The right to regret therefore ends when you break the seal.

8.3 Right of withdrawal food, When ordering food, no right of withdrawal applies.

8.4 If you want to cancel the purchase, you must, before the cancellation period expires, send a clear message to Butikkom. You must enter your name, address and other relevant information, e.g. order number, invoice number and name of the item in the message.

8.5 When exercising the right of withdrawal, you pay the return shipping and are responsible for the condition of the goods after you have received the goods and during the return shipping. The item must be returned within 14 days from the date the notice of exercise of the right of withdrawal was given to Butikkom. The item must be sent well packaged, in good condition and in the original box. Returns must be made to Butikkom according to the methods and instructions specified on the Site.

8.6 When you cancel your purchase, Butikkom pays back the amount you paid for the item, excluding SEK 69 delivery costs. From the amount to be refunded, Butikkom has the right to deduct an amount corresponding to the item's decrease in value compared to the item's original value, if and to the extent that such decrease in value is due to you handling the item to a greater extent than is necessary to determine its properties or function.

8.7 Butikkom pays back the amount as soon as possible, but no later than within 14 days from the date Butikkom received your notice of exercise of the right of withdrawal. However, Butikkom may wait with the refund until Butikkom has received the item or You have shown that the item has been sent back, e.g. through a submission receipt. The refund will be made to you via the payment option you chose, provided that nothing else has been agreed or that there are obstacles to such refund. Butikkom takes no responsibility for Klarna's refund and case handling time.

9, Warranty and Complaints

9.1 Some of Butikkom's goods may be covered by a warranty. Information about any warranty period and special warranty conditions for each product can be found on the Site or in these Terms and Conditions. Warranty for goods only covers original manufacturing defects, and thus not defects that occur during or after a change in the product's function and appearance, such as rebuilding, upgrading or other configuration of the product, this does not apply to food. Your order confirmation is valid as proof of warranty.

9.2 The right of complaint covers goods that are faulty according to current consumer protection legislation. A customer who wishes to claim an error in an ordered item must contact Butikkom as soon as possible after the error is discovered via the contact details provided on the Site. Complaints made within three weeks from when you discovered the fault are always considered to have been submitted in time. When buying food and you discover that the goods are damaged during transport, you must send pictures of the box and all damaged products, then contact Butikkom no later than 48 hours after you have collected the package from the Servicepoint.

9.3 Cans for Collectors: Unfortunately, we cannot guarantee that cans containing drinks will reach you in perfect condition without cosmetic defects. Butikkom does its utmost to ensure that the product is packed so well that this does not occur, however, we receive cans from our suppliers that already have a defect before they go out to the customer.

9.4 Butikkom is responsible for the return shipping for approved complaints.

9.5 When the complained item is returned and the complaint is approved, Butikkom will compensate you in accordance with current consumer protection legislation. Butikkom strives for this to take place within 14 days of Butikkom receiving the complaint, but it may take longer depending on the nature of the product. Butikkom reserves the right to deny a complaint if it turns out that the product is not faulty according to current consumer protection legislation. 10, Force Majeure

Butikkom is not responsible for delays caused by circumstances beyond Butikkom's control, such as, for example, general labor conflict, extreme weather conditions, war, fire, lightning, terrorist attack, changed authority regulations, technical problems, errors in electricity/telecommunications/data connections or other communications, and errors or delay in subcontractor services due to circumstance specified herein. These circumstances shall constitute a basis for exemption which entails exemption from damages and other penalties. If any such situation were to arise, Butikkom will inform you partly at the beginning and partly at the end of the time for the current situation. If the circumstance has lasted longer than two months, both you and Butikkom have the right to cancel the purchase with immediate effect.

11, Changes to the Terms

Butikkom reserves the right to make changes to these Terms and Conditions at any time. Any changes to these Terms will be posted on the Site. Changes apply from the moment you have accepted the Terms (in connection with a new purchase or when visiting the Site), alternatively 30 days after Butikkom has informed you of the changes. However, Butikkom recommends that you keep updated on the Site regularly to be aware of any changes to the Terms and Conditions.

12, Applicable Law and Dispute

12.1 Disputes must primarily be resolved by consensus after discussion with Butikkom's customer service.

12.2 If the dispute cannot be resolved in agreement with Butikkom's customer service, you as a customer can turn to ARN (General Complaints Board), which you can find more information about at www.arn.se. You can also submit complaints directly online via the European Commission's platform for mediation in disputes, which you can find via the following link http://ec.europa.eu/consumers/odr. If you submit a complaint via this platform, your case is automatically forwarded to the appropriate nationally responsible dispute resolution body. This dispute resolution body then contacts us and tries to resolve the dispute without court involvement. In the event of a dispute, Butikkom follows the decision of ARN or the corresponding dispute resolution body.

12.3 Disputes concerning the interpretation or application of these Terms and Conditions shall be interpreted in accordance with Swedish law and settled in accordance with point 12.2 above or in the last instance by a general court.
